These Terms of Service ("Terms") govern your use of the Bowball app and the bowball.net website (together, the "Service"), provided by Cullum Design Pty Ltd (ABN 14 632 700 559, ACN 632 700 559), Melbourne, Victoria, Australia ("Bowball", "we", "us"). By using the Service you agree to these Terms.
Bowball is currently distributed as an invite-only private beta. Access may be limited, revoked, or changed at any time, and features described on this website or in the app may change or be removed without notice while the Service is in beta.
You need an invitation and an account (via Firebase Authentication) to use Bowball. You're responsible for keeping your account credentials secure and for activity under your account. If you're under 18, you should use Bowball with the involvement of a parent, guardian, or supervising coach/club.
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Bowball app on your own devices, for your own rowing training purposes, subject to these Terms. You may not reverse-engineer, resell, or redistribute the app, or use it to build a competing product.
You own the session data you generate (GPS tracks, stroke metrics, etc). We process it as described in our Privacy Policy to provide the Service back to you (history, career stats, coaching feedback).
Don't use Bowball to: violate any law; interfere with the Service's operation or other users' access to it; attempt to access accounts or data that aren't yours; or upload content that infringes someone else's rights.
Bowball is a training-analysis tool, not a safety device. It is not a substitute for coach supervision, proper on-water safety practice, or awareness of your surroundings while rowing. You're responsible for your own safety on the water regardless of what the app reports.
The Service is provided "as is" during private beta, without warranties of any kind, express or implied, including as to accuracy of any metric, fitness for a particular purpose, or uninterrupted availability. Stroke metrics (check, bounce, wash, etc.) are technique indicators derived from sensor data, not medical or safety measurements.
To the maximum extent permitted by Australian law, Cullum Design Pty Ltd is not liable for any indirect, incidental, or consequential loss arising from your use of the Service. Nothing in these Terms excludes any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
We may suspend or terminate your access to the Service at any time during the private beta, including to manage capacity or discontinue a feature. You may stop using the Service and request account/data deletion at any time via admin@bowball.net.
We may update these Terms as the Service evolves out of beta. We'll update the date above and, for material changes, notify active testers directly.
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts.
